ASBESTOS INSPECTIONS - OWNERS OF BUILDINGS CONTAINING WORKPLACES

IT'S THE LAW

Our Team have spoken to many professionals who are confused by the new Occupational Health and Safety regarding Asbestos.

The Legislation simply put is as follows:

A building is a workplace, if:
(a) it is commercial premises
(b) unit buildings - if a property manager or body corporate manager arranges maintenance
(c) if paid or unpaid workers are engaged at the premises.

Regardless of what you know the building is constructed of, it must be inspected by an Appropriately Qualified Person.
Workplaces built prior to 1990 must be inspected prior to 1st January 2008, unless the building is to be sold, leased, demolished or refurbished in which case you must provide a copy of the Report, prior to that event.

Important Note- If your building has been previously inspected under old Queensland legislation (materials and product audit) your report may no longer be valid. This change was necessitated by adoption of the national code of practice "management of asbestos in buildings".

The building owner or the person substantially in control (eg Building Manager, Body Corporate Manager and Property Manager) of the building is responsible for obtaining the report.
